[...] As we earlier wrote about, one of the main topics of Steve Jobs’ keynote at the 2007 Macworld Expo and Conference was the much sought-after iPhone. Much has been speculated about how Apple’s phone would be, and even how it would be called, given that the “iPhone” trademark is actually already been owned by Cisco. Nonetheless, Apple chose to name its product “iPhone”, and it seems to be an exciting product! [...]

[...] Hot on the heels of the 2007 MacWorld Expo and Conference in San Francisco, California, the iPhone seems to be the most talked-about word in the blogosphere. In fact, not only did it elicit fanboy-dom among Apple loyalists, it also got the attention of just about anyone interested in technology. And yes, even legal pundits tuned into the talk because of the lawsuit that Cisco lodged against Apple for its use of the iPhone trademark. Apparently, Cisco has owned the name since the early 2000’s, but that didn’t stop Apple from using the “i” moniker that it feels it had popularized with the iMac, iBook, and yes, even the venerable iPod.
Actually, it could be relevent whether the name 'iPhone' has ever been used as a trademark before - trademarks do not apply across all areas. For example, I could possibly use the name 'blog herald' if it referred to some sort of notification software, even if you had registered it as a trademark.

Obviously the precise rules vary accross national boundaries, though.
